holi-lets Terms & Conditions for Holiday Customers

Holi-lets.com accepts reservations of holiday accommodation on the following conditions:

Holi-lets.com act as booking agents on behalf of the owner and hereby notifies you that the sole purpose of the letting is for holiday accommodation.

Holiday accommodation within the UK is let by virtue of Section 9 part 1 of the Housing Act 1988. This is not an Assured Tenancy and possession may be recovered under Ground 3 in Schedule 2 of the Housing Act 1988.

The contract entered into is solely between the holiday customer and the owner/s who have undertaken to provide linen (where applicable), utilities (unless otherwise stated) equip, maintain, clean and make the holiday property available for holiday letting.

Holi-lets.com act as booking agents and as such are not responsible for any property maintenance matters whether a property is either occupied or empty between lets.

Whilst every effort is made to ensure the accuracy of the information on our website and within any written correspondence or literature, holi-lets.com cannot be held responsible for any alterations or changes at properties beyond our reasonable control. Furthermore, holi-lets.com cannot be held responsible for any neglect or default on the part of the owner nor for any damage, expense, loss, accident, injury or inconvenience, whether to persons or to the property which the occupier or any other person/s may suffer or sustain arising out of the use of the property and its amenities.

Disputes

Holi-lets.com shall not be responsible in the event of any dispute arising between the holiday customer and owner, and no correspondence will be entered into. Holiday customers with grievances should make contact during their stay directly to the owner/owner’s representative.

Username & Password

holi-lets.com will provide all holiday customers with a username and password so that they can make their initial booking and payment on-line and track their on-line booking. Access has been made easy, and can be carried out from anywhere in the world!

Bookings

Only persons over the age of eighteen years can make holiday bookings. The lead person will be responsible for the entire booking and its associated cost and upon signing/accepting the booking conditions, accepts the conditions on behalf of all of the party members.

Booking procedures are outlined within the holi-lets.com website under the `Booking’ section. A computer generated receipt will be emailed to the holiday customer upon receipt of the on-line booking form, acceptance of the `Terms & Conditions’ and payment of the booking fee and deposit (which is 30% of the cost of the holiday accommodation) or the payment in full (if the booking is made within eight weeks of departure). Owners and holiday customers will be able to track their booking/s and payments made/due through their on-line account via their username and password.

`Enquiry only' bookings

Booking enquiries will be forwarded to the holi-lets admin team through the site, and when availability and pricing has been accepted by all parties, a member of the team will make the initial booking on line, and then as outlined in the aforementioned paragraph the holiday customer and owner will receive confirmation emails and the same procedures will apply to the booking. 
 
Security deposit

If a security deposit is required (at the request of the owner), then this will be payable with the final payment eight weeks prior to departure. The security deposit will be transferred to the owner. The security deposit will be returned by the owner directly to the occupier shortly after vacation. No correspondence will be entered into by holi-lets.com regarding deductions from the security deposit.

Balance payments

It is the responsibility of the lead occupier to ensure that the balance payment is made eight weeks prior to departure and is payable to holi-lets.com. If the balance payment is not received by the due date holi-lets.com reserves the right to cancel the booking, forfeiting the deposit paid to the owner. All balance payments should be made via the holi-lets.com website using your username and password/over the phone or in person. 

Booking fee

A booking fee of £15.00 inc. VAT is payable per booking. This fee is non refundable if you cancel your holiday booking.

Credit card payments

A fee of 2% inc. VAT surcharge is payable on all payments made via credit card. Debit card payments incur no extra charges.

Last minute bookings

Last minute bookings can only be made within seven days of departure, are payable in full at the time of booking and attract a discount of 20% of the holiday accommodation price. Please note: Last minute booking discount does not apply to short breaks and those properties already offering special discounts.

Short breaks

Short breaks can only be booked two weeks prior to departure and are payable in full at the time of booking. A short break is charged at 70% of the weekly rate for the first three days and then 15% of the weekly rate is charged for each extra day thereafter. Please note that it is not usual for owners to offer short breaks during high season and that short breaks cannot overlap a changeover day.

Holiday owners can make special offers available throughout the holiday calendar. Please note that the website will automatically calculate the discount on the booking page.

Special requests

Special requests by the holiday occupiers may be made in writing and are subject to approval by the owners.

Cancellation by the occupier

Cancellations made prior to eight weeks of holiday departure date, incur loss of one third deposit, the booking fee, credit card charges and any other associated charges. Those cancellations made within eight weeks of holiday departure incur loss of the total holiday cost, the booking fee, credit card charges and any other associated charges. Any security deposit payments made on account will be returned in full.

Cancellation by the owner

If for any reason beyond the owner’s control the property is not available on the dates booked and has to be cancelled, holi-lets.com will not be held responsible, but will however, endeavour to find alternative holiday accommodation.

Any monies paid will be refunded in full by the owner to the holiday customer via holi-lets.com. The owner will then be responsible for the full refund of monies paid by the holiday customer at time of cancellation, including booking fee, credit card charges and any associated charges where applicable. Any security deposit payments made on account will also be refundable in full. The holiday customer shall have no further claim on the owner.

Holiday property double booked

In the event that any booking made should be inadvertently double booked, holi-lets.com will not be held responsible, but will however endeavour to find alternative holiday accommodation.

Holiday customer conduct & damages

The holiday customer undertakes to take good care of the property and to keep the property and all furniture, fittings and effects in or on the property in the same state of repair and condition as at the commencement of the holiday (reasonable wear and tear accepted). Holiday customers will replace any breakages with similar articles of at least equal value, making sure that the property is left in a clean and tidy condition. Holiday customers will reside in a quiet and courteous manner, read and adhere to any written advice left in the property by the owners and assist in the smooth running of the property.

If any item is damaged and cannot be easily replaced by the holiday customer, the holiday customer should make contact with the owner/owner’s representative and an agreed payment should be made in lieu. If the damage is not reported before departure a claim will be made for damage or lack of cleanliness against the lead person after departure.

Emergencies

In the unlikely event that the occupier cannot contact the owner/owner’s representative in the case of an emergency, Holiday customers should act responsibly and only call out contractors where absolutely necessary. 

Equipment & Services

The holiday customers are not entitled to compensation for failure of equipment or services relating to their holiday booking. Should failure of any equipment or service occur during your stay it should be reported immediately, upon which time the owner will endeavour to rectify the situation as quickly as possible. No correspondence will be entered into by the owner in connection with any complaint made by the holiday customer after the property has been vacated.

Occupants

Owners have safety/insurance restrictions regarding total numbers of permitted occupants, pets, smokers and children. Holiday customers must therefore strictly adhere to these requirements.

No other person may reside at the property other than those listed on the booking form. Name changes are acceptable up until the date of the holiday commencement. (A small fee of £10+VAT will be charged if the lead name needs to be changed on the booking by holi-lets.com for this administration service).

Key arrangements

The holiday customer is required to make contact with the owner/owners representative a few days before departure to ascertain the key arrangements for the property. The owner undertakes to ensure that the keys are available on time. Keyholder details will be emailed with the final payment receipt.

In the event that keys need to be posted to the holiday customer, the owner/keyholder will contact the holiday customer and arrange for them to be posted to them, owner/keyholder contact details will be emailed to the holiday customer within the final balance confirmation email.
 
Utilities

The owner will maintain the property to the highest standard, paying for the gas, electricity, council tax, water, building/contents insurance, service/maintenance /management charges.

N.B. Some holiday property owners require holiday customers to pay for utilities used during their stay, information regarding this requirement is obtained within the holi-lets.com website within the property description. Detailed information regarding the payment for utilities will be available at the holiday property.

Statutory regulations

With regard to Statutory Regulations, Health & Safety and the supply of gas, electricity, furnishings and fittings, holi-lets.com cannot be held responsible for any regulations or disability requirements that are not abided to by holiday home owners/holiday customers. All holiday customers should make themselves aware of statutory regulations set out by the authority of the country in which they are holidaying before the commencement of their holiday to satisfy their own requirements.  Click here for further information on the regulations

Owner’s responsibility to occupiers

Owners undertake to make sure that the property is presented in a clean and satisfactory condition at the commencement of each holiday rental.

At the property, holiday occupiers will be supplied with clear instructions for the use of all appliances, heating and alarms. Information regarding local attractions, facilities, shops, dentists, doctors, etc should also be provided. Holi-lets.com will not be held responsible for the content of the information packs.

Property description

holi-lets.com makes no representation as to the accuracy of the information contained within the holi-lets.com website. Holi-lets.com has not confirmed the accuracy thereof and accordingly holiday customers are strongly recommended to make their own investigations into the authenticity of any information supplied. Holi-lets.com are in no way liable for any inaccuracies or misleading statements made in the information provided by the owner or agent of the properties on the website.

Holiday Property Grading

holi-lets.com will place holiday property grading signs within owner’s website description on holi-lets.com website upon receipt of a copy of a valid certificate from the owners.

Acceptance

Acceptance of this booking by the owner confers upon the occupiers in the UK the right to occupy the property within the meaning of Section 9 of the Rent Act 1977 for a holiday.

Vacation

All holiday customers must note that they are required to vacate on the vacation day by the given time for that particular holiday property. Should the holiday customer fail to vacate on the designated date they will be liable to pay hotel bills for the incoming visitors and associated expenses.

Cleaning staff are pre-booked so unless the holiday customer has agreed with the owner prior to the stated vacation time that he/she wishes to prolong their stay and has paid for the extra-agreed period, all holiday customers are expected to vacate on time.

Holiday insurance

We strongly advise that holiday customers, whether travelling abroad or not, take out appropriate holiday insurance offering the same or greater protection to cover the likelihood of cancellation or curtailment. The cost of medical and other treatment overseas can be high, and if you do not have insurance holi-lets.com will not be held responsible for the refund of any holiday booked that is not available upon arrival, and as such will not be responsible for hotel bills and associated expenses that might be incurred. However holi-lets.com will do their very best to be of assistance and to mitigate the loss where possible.
