holi-lets Terms & Conditions for Holiday Owners

holi-lets.com accepts reservations for holiday accommodation on the following conditions:

holi-lets.com acts as booking agent on behalf of the owner and hereby notifies you that the sole purpose of the letting is for holiday accommodation.

Holiday accommodation within the UK is let by virtue of Section 9 part 1 of the Housing Act 1988 this is not an Assured Tenancy and that possession may be recovered under Ground 3 in Schedule 2 of the Housing Act 1988.

The contract entered into is solely between the holiday customer and the owner who has undertaken to provide linen (where applicable), utilities (unless otherwise stated) equip, maintain, clean and make the holiday property available for holiday letting.

holi-lets.com acts as booking agent and as such is not responsible for any property maintenance matters whether a property is either occupied or unoccupied between lets.

Whilst every effort is made to ensure the accuracy of the information on holi-lets.coms website, and within any written correspondence or literature holi-lets.com cannot be held responsible for any alterations or changes at properties beyond reasonable control. Furthermore, holi-lets.com cannot be held responsible for any neglect or default on the part of the owner nor for any damage, expense, loss, accident, injury or inconvenience, whether to persons or to property which the holiday customer or any other person may suffer or sustain arising out of the use of the property and its amenities.

Disputes

holi-lets.com shall not be responsible in the event of any dispute arising between the holiday customer and owner, and no correspondence will be entered into. Holiday customers with grievances should make contact during their stay direct to the owner/owners’ representative.

Username & Password

holi-lets.com will provide all owners with a username and password so that they may make changes on-line, if desired, to their property description, availability, pricing, add special offers and to check their on-line account. Updating has been made easy and can be carried out from anywhere in the world!

Bookings

Booking procedures are outlined within the holi-lets.com website under the `Booking’ section. A computer generated confirmation of the booking will be emailed to the owner as soon as the deposit is paid on-line and the website availability section will automatically be updated. A computer-generated receipt will be emailed to the occupiers upon receipt of the on-line booking form, acceptance of the `Terms & Conditions’ and payment of the deposit (which is 30% of the cost of the holiday accommodation) or the payment in full if the booking is made within eight weeks of departure. Owners and holiday customers will be able to track their booking/s and payments made/due through their on-line account via their username and password.

`Enquiry only' bookings

Booking enquiries will be forwarded to the holi-lets admin team through the site, and when availability and pricing has been accepted by all parties, a member of the team will make the initial booking on line, and then as outlined in the afore-mentioned paragraph the holiday customer and owner will receive confirmation emails and the same procedures will apply to the booking. 
 
Balance payments by the holiday customer

It is the responsibility of the holiday customer to make sure that the balance payment of monies due is made eight weeks prior to departure to holi-lets.com via the website/over the phone or in person. If payments are not received by the due date holi-lets.com reserves the right to cancel the booking forfeiting the one-third deposit to the owner.

Security deposit

If a security deposit is required then this will be taken from the holiday customer with the final payment eight weeks prior to departure. The security deposit will be transferred to the owner with the final payment, and it is the owner’s responsibility to return it direct to the holiday customer shortly after vacation. No correspondence will be entered into by holi-lets.com regarding deductions from the security deposit.

Special requests

Special requests by the holiday customer may be made in writing and are subject to approval by the owners.

Cancellation by the holiday customer

Cancellations made prior to eight weeks of holiday departure date, incur loss of deposit, cancellations made within eight weeks of holiday departure incur loss of total holiday cost. Any security deposit payments made on account will be returned in full.

Cancellation by the owner

In the event that any booking made should be cancelled, holi-lets.com will not be held responsible, but will, however, endeavour to find alternative holiday accommodation. Any monies paid will be refunded in full by the owner to the holiday customer via holi-lets.com. The owner will then be responsible for the full refund of monies paid by the holiday customer at the time of cancellation, including a booking fee of £15, credit card charges and any associated charges where applicable. Any security deposit payments made on the account will also be refundable in full.

A surcharge will be payable upon cancellation by the holiday owner to holi-lets.com of 10%+VAT of any holiday accommodation monies paid to cover administration. The holiday customer will have no further claim on the owner.

Acceptance

Acceptance of a booking by the owner confers upon the holiday customer in the UK the right to occupy the property within the meaning of Section 9 of the Rent Act 1977 for a holiday.

Holiday property double-booked

In the event that any booking made should be inadvertently double booked, holi-lets.com will not be held responsible, but will however endeavour to find alternative holiday accommodation.

Holiday customer conduct & damages

The holiday customer undertakes to take good care of the property and to keep the property and all furniture, fittings and effects in or on the property in the same state of repair and condition as at the commencement of the holiday (reasonable wear and tear accepted) and shall replace any breakages with similar articles of at least equal value, making sure that the property is left in a clean and tidy condition, to occupy the property in a quiet and courteous manner, to read and adhere to any written advice left in the property by the owners and to assist in the smooth running of the property.

If any item is damaged and cannot be easily replaced by the holiday customer, the holiday customer should make contact with the owner/owner’s representative and an agreed payment should be made in lieu. If the damage is not reported before departure a claim will be made for damage or lack of cleanliness against the lead person after departure.

Emergencies

In the unlikely event that the holiday customer(s) cannot get hold of the owner/owner’s representative in the case of emergency, holiday customers should act responsibly and only contact contractors where absolutely necessary. 

Equipment & Services

The holiday customers are not entitled to compensation for failure of equipment or services. Should failure of any equipment or service occur during the occupier’s stay it should be reported immediately, upon which time the owner will endeavour to rectify the situation as quickly as possible. No correspondence will be entered into by the owner in connection with any complaint made after the property has been vacated by the holiday customer.

Key arrangements

The holiday customer is required to make contact with the owner/owner’s representative a few days before the commencement of the holiday to establish what the key arrangements are for the property. The owner undertakes to ensure that the keys are available on time. Keyholder details will be emailed with the final payment receipt.

In the event that the owners need to post the keys to the holiday customer, the keyholder details section within the property edit screen should reflect this, and booking confirmation emails will detail lead persons contact details.
 
Holiday property insurance

holi-lets.com strongly advises that all property owners take out holiday insurance specifically for holiday homes as it is the responsibility of the property owner to be adequately insured for holiday rentals.  If for any reason the owner has to cancel the holiday accommodation, not only does he/she have to refund the customer any monies paid in full but also he/she must be aware that there is a potential liability for hotel bills and administration costs. Utilities

The owner will maintain the property to the highest standard, paying for the gas, electricity, council tax, water, t.v. license, building/contents insurance, service/maintenance /management charges (unless otherwise stated within the property description).

N.B. If owners require holiday customers to pay for any utilities used during their stay, information regarding this requirement should be detailed within the description of the holiday property within the holi-lets.com website. Detailed information regarding payment for utilities must also be available at the holiday property.

Statutory regulations

All owners should make themselves aware of Statutory Regulations & Health & Safety requirements set out by the authority of the country in which their holiday home is situated with regard to the supply of gas, electric, fire, furnishings, disability and income-tax obligations for Non-UK Residents. Holi-lets.com cannot be held responsible for any regulations that owners/holiday customer(s) do not abide by.   Click here for further information on the regulations

Owners’ responsibility to holiday customers

Owners must make sure that the property is presented in a clean and satisfactory condition at the commencement of each holiday rental.

Owners must provide clear instructions within the holiday property for the use of all appliances, heating and alarms. Owners must also leave contact numbers for owners/owner’s representatives and an information pack detailing local attractions, facilities, shops, doctors, dentists etc. holi-lets.com will not be held responsible for the content of the information packs.

Holiday Property Grading

holi-lets.com will place holiday property grading signs within the owner’s website- description after holi-lets have received a copy of a valid certificate from the owners.

Availability

The owner will be able to update the availability of the holiday property on-line with a username and password. Updates must be made as soon as a booking is taken by the owner direct, so that the website is as up-to-date as possible, avoiding double bookings where possible.

holi-lets.com website will automatically update the availability for the property as soon as a booking has been made. An email will be automatically sent to the owner and occupier confirming the booking.

Owners undertake to make sure that they check availability at the holi-lets.com website before blocking off any periods for owners use/own bookings. There is no facility to hold bookings awaiting payment.

Owners may block off as many weeks as they wish without penalisation.

Pricing

Owners will be able to change the pricing set on the holi-lets.com website on-line with a username and password, which will enable owners to make reductions where necessary, and to forward-plan for the coming year’s charges. It is recommended that owners refrain from continually changing their pricing schedules, in order to avoid confusion.

Special Offers

Owners are able to apply special offers to their properties on the holi-lets.com website on-line easily using their username and password. To include the property in the `Special Offers’ section use the drop-down menu found in the owner's property description section, choose the desired discount and the month/s that you wish the offer to apply to.

Last Minute Bookings

Owners are able to add their property to the last minute booking search on the holi-lets website using their username and password. To include the property in the `Last Minute’ section tick the last minute box found in the owner’s property description section. 20% discount will be applied on all bookings made within seven days’ departure.

Short Breaks

Owners are able to make their property available for short breaks on the holi-lets website using their username and password. To include the property in the `Short Breaks’ section use the drop-down menu found in the owner’s property description section, and choose the desired month/s that you wish the offer to apply to.

Short breaks can only be booked two weeks prior to departure (unless it has been agreed with the owner, via an enquiry made to holi-lets), and are charged at 70% of the weekly rate for the first 3 days and then 15% of the weekly rate is charged for each extra day thereafter. Holiday customers are advised that they may not book over a change-over period.

Only one discount will be applied per booking. The website will automatically calculate the highest discount available! 
 
Featured Property

Owners are able to make their property available to appear in the featured property section on the home page of the website easily using their username and password. To include the property in the `Featured Property’ section tick the featured property box found in the owner’s property description section. Your property will appear on a rotating basis on the home page for a period of 7 days from the day on which you activate the service. A charge of £10 + VAT per week  will be applicable. A payment screen will appear to enable owners to pay for this service. To stop the property being advertised as a featured property simply take out the tick in the owner’s property description section.

Advertising

holi-lets.com provides advertising within its website free of charge for all owners on a `No let, no fee’ basis. The layout of all advertisements are pre-set by holi-lets.com ensuring that the site looks well presented at all times.

holi-lets.com charges

holi-lets.com acts as the booking agent and will charge the owner’s account up to 10% + VAT of the total cost of the holiday accommodation for each booking secured. The same charge will be applicable when a booking has been forfeited through cancellation by the occupier, applicable to those monies held on account at that time.

Property advertisements are accepted subject to the approval of holi-lets.com. The layout and design of the advertisement will be at the sole discretion of holi-lets.com.

If holi-lets.com considers that the advertisement or any part of it thereof would be detrimental to the reputation of the website or in any way inappropriate or offensive, hol-ilets.com reserves the right to suspend/alter the advertisement with immediate effect.

Holiday owners will not be allowed to insert their own website or email addresses, and although owners may import the holi-lets availability and pricing into their website to allow for on-line bookings 24/7, holi-lets will not allow links to owners websites from theirs.
 
Payments to the owners

Initial deposit payments will be held by holi-lets.com within their client account and will be forwarded to the owners along with the final payment and any agreed security deposit, less charges shortly after the commencement of the holiday.

It is the responsibility of the Owner to ensure that their banking details are kept up to date for the payments to be made via BACS transfer
 
On-line Account

Owners will easily be able to access their on-line account held within the holi-lets website using their username and password. Owners will be able to see bookings made, and track their progress as well as the fees due to the Owner.

holi-lets undertakes to make sure that their website is constantly featured on all major search engine sites, that the site looks professional at all times, and that owners are getting the required response in order to secure maximum bookings.
