Holi-lets.com Terms & Conditions for Owners & Bookers

Terms & Conditions that you will be asked to accept when advertising your holiday rental through holi-lets.com. We reserve the right to change an add to these terms at any time.

holi-lets.com accepts reservations for holiday accommodation for Holiday Owners and Bookers on the following conditions:

holi-lets.com acts as booking agent on behalf of the Owner and hereby notifies you that the sole purpose of the letting is for holiday accommodation.

Holiday accommodation within the UK is let by virtue of Section 9 part 1 of the Housing Act 1988 this is not an Assured Tenancy and that possession may be recovered under Ground 3 in Schedule 2 of the Housing Act 1988.

The contract entered into is solely between the holiday booker and the owner who has undertaken to provide linen (where applicable), utilities (unless otherwise stated) equip, maintain, clean and make the holiday property available for holiday letting.

holi-lets.com acts as booking agent and as such is not responsible for any property maintenance matters whether a property is either occupied or unoccupied between lets.

Whilst every effort is made to ensure the accuracy of the information on the holi-lets.com website, and within any written correspondence or literature holi-lets.com it cannot be held responsible for any alterations or changes at properties beyond reasonable control. Furthermore, holi-lets.com cannot be held responsible for any neglect or default on the part of the owner nor for any damage, expense, loss, accident, injury or inconvenience, whether to persons or to property, which the holiday customer or any other person may suffer or sustain arising out of the use of the property and its amenities. Holi-lets.com offers no guarantees.

 

Holi-lets.com Fees to Owners

NO ANNUAL FEE CONTRACT

It is FREE to LIST a holiday property to let on holi-lets.com. ‘No LET no FEE’. When a booking reservation is confirmed and the deposit and full payments are made to holi-lets.com the payment will be forwarded to the owner after administration and bank clearance as soon as is possible at the end of the stay.  

Upon taking a booking reservation a non-refundable deposit of 40% we will be taken from the booker to secure the let, 8 weeks before departure the full amount of the rental will become payable.

 

TRANSPARENCY

There are NO hidden fees, THE OWNER SETS THE RENTAL PRICE, (this should be the same base price that the owner advertises the property for on all portals). The owner pays 10%+VAT of the agreed rent for the property to holi-lets.com, who acts as ‘The Booking Agent’. The fees cover: processing, administration, advertising and associated costs of running and maintaining the website and social media presence, back-ups and performance.

 

Holi-lets.com Fees to Bookers

Upon taking a booking reservation a non-refundable deposit of 40% we will be taken from the booker to secure the let, 8 weeks before departure the full amount of the rental will become payable.

The fees cover: processing, administration, advertising and associated costs of running and maintaining the website and social media presence, back-ups and performance.

 

COMMERCIAL OWNERS & BOOKERS

If you are creating an account for commercial purposes and are accepting this Agreement on behalf of a company, organisation or other legal entity, you represent and warrant that you are authorised to do so and have the authority to bind such entity to this Agreement, in which case the words “you” and “your” as used in this Agreement shall refer to such entity and the individual acting on behalf of the company shall be referred to as a “Business Representative”.

 

 

TERMINATION

Holi-lets.com may terminate this Agreement with you at any time, without advanced notice, where it believes in good faith that you have breached this Agreement or otherwise believes that termination is reasonably necessary to safeguard the rights of the Holi-lets.com Companies and/or others users of the Services. That means that we may stop providing you with Services.

 

The Owners responsibilities to the Booker

The owner agrees that he will make sure that the property is presented in a clean and satisfactory condition at the commencement of the holiday rental, that the property is available as booked and that it is fit for habitation, not to make any breaches, to be open to special requests, to put in place a complaints procedure, to ensure that the property is risk assessed as far as possible, to make sure that the property has a current gas safety certificate, a current electrical certificate and annual portable appliance testing, and adhere to fire & safety regulation requirements regarding the holiday property and its contents. To observe and be aware of the cancellation procedures, show forbearance regarding covid and lockdown rules.

Owners must provide clear instructions within the holiday property for the use of all appliances, heating and alarms. Owners must also leave contact numbers for owners/owner’s representatives and an information pack detailing local attractions, facilities, shops, doctors, dentists etc. holi-lets.com will not be held responsible for the content of the information packs.

 

 

BOOKERS INFO and RESPONSIBILITIES

You must be over 21 to book a holiday property. You will need a debit or credit to secure a booking.

We will email you an acceptance of the booking confirmation to the email address that you provided during the booking reservation process. This acceptance email, once received will form the contract between us. If you think that a mistake has occurred within the booking process please call us within 24 hours of booking. Please check that your reservation details are accurate before you confirm your reservation. We cannot be liable for any incorrect information that you have provided us with.

 

Holiday Property prices do not attract VAT. Meals of any type are not included unless stated otherwise within the property owners profile.

 

Occupancy

 

The maximum property occupancy is as stated within the property details as advertised on holi-lets.com. You must not exceed the maximum occupancy for the property. We reserve the right to conduct checks on occupancy. Occupancy is not transferable.

 

Children under 21 are not permitted to stay unless a parent or guardian is also staying at the property. We reserve the right to request valid photographic proof of identity and age, so please bring this with you otherwise where requested you will not be permitted to stay.

 

Accessibility & Special Requests

 

Please feel free to contact us to ascertain the feasibility of any disability requirement or special request that you may have prior to confirming your reservation.

 

Deposit

 

Upon booking and reserving your holiday rental property you will be required to pay a deposit of 40% of the total price of the holiday period booked. This deposit is non-refundable. In some super extenuating circumstances (COVID / Lockdown) the week booked may be transferable to another date within 12 months of the original booking, but this is totally at the discretion of the Holiday Property Owner. Please contact the holi-lets office should this situation have occurred. Any difference in higher transfer rates for the property would be payable in full at point of transfer plus a transfer fee of £20+VAT to holi-lets.com. If the total value of the new stay is less than the original booking any difference is forfeited.

 

You are not entitled to cancel or withdraw from your booking reservation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.


Holi-lets.com right to cancel

 

Your breach

We may cancel your booked reservation at any time with immediate effect by giving you notice in writing (which includes email) in the following instances, if:

  • you do not pay us when you are required to do so; or
  • you break the contract between us in any way.

If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract. Where your stay had/has not commenced yet, the total payment made or to be made by you for such room shall be deemed a cancellation charge.

 

Extenuating Circumstances regarding `Events’ outside of our control

We may also cancel your booking reservation if an event outside of our control (including; for any reason that your holiday property owner should not be able to fulfil their side of the contract due to ill health, breakdown or incapacity, industrial action, explosion, outbreak of disease, health and safety issues, fire, flooding, and failure of power and/or water supplies or emergency evacuation) means that we are unable to make your holiday property available to you. We will contact you to let you know as soon as possible and:

  • if you have already paid for your holiday property, we will refund your payment to you; or
  • if you have not yet paid for your holiday property, you will not have to make any payment to us.

Furthermore, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control. This does not affect your statutory rights.

 

 

The Holiday Booker agrees that

 

They will not:

  • smoke anywhere inside the property, this includes communal gardens and hallways & Lifts. This includes the smoking of e-cigarettes.
  • cause any health and safety hazard to any of the areas of the holiday property inside or outside.
  • bring any pets onto the property or within the property unless permission has been given by the owner, with the exception of assistance dogs; however not deemed suitable or allowable within a communal flat or apartment block situation or similar.
  • bring any potentially dangerous or hazardous materials or equipment onto the property;
  • tamper with any fire alarms, emergency equipment or heating controls;
  • prevent management, housekeeping and/or maintenance staff from access to your holiday property, management will endeavour to give prior notice but this cannot be guaranteed in the event of an emergency;
  • remove, damage or destroy any holiday property furnishings or contents;

 

COVID-19 (Coronavirus): you must immediately notify us to the extent you or anyone staying within your party tests positive for the virus or if they are self-isolating or should be self-isolating pursuant to Government guidelines. In any event, the holiday property owner reserves the right to cancel any booking reservation (before or during the stay).

The lead booker will be responsible if they or a member of their party causes damage or loss of any kind to the holiday property or its contents, you (as the person making the booking) will be responsible for that damage or loss and you shall be liable to pay to the property holiday property owner, on demand, the amount required to make good or remedy such damage or loss.

 

You and the members of your group must not resell or transfer your booking reservation (or any part of it) nor advertise, market or otherwise offer the property for sale.


If you or any member of your party causes damage to the holiday property, the holiday property owner reserves the right to:

 

  • cancel your booking reservation with immediate effect and (if appropriate) eject you from the premises;
  • remove your items from the property, disposing of such items (at no cost and no liability) to a local charity to the extent such items are not collected from a designated safe storage place from the owner within 7 days of removal;
  • retain all sums paid by you and/or charge you the full amount of removal and storage of personal item;
  • refuse future booking reservations from you.

 

 

The holiday property owner will not be liable for any refund or compensation in such circumstances.

 

 

 

Applicable law

 

If you are a consumer you and we both agree that the courts of England and Wales will have non-exclusive jurisdiction over any claim arising from, or related to, your holiday property booking reservation. We retain the right to bring proceedings against you for breach of these terms and conditions in your place/country of residence or any other relevant place/country.

 

If any part of these terms and conditions is deemed invalid by a court of law, illegal or for any reason are unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under our terms and conditions or shall not be construed as a waiver by us of those or any other rights or remedies.

 

All of your rights not expressly granted in these terms and conditions are reserved.

 

Statutory regulations

All Owners should make themselves aware of Statutory Regulations & Health & Safety requirements set out by the authority of the country in which their holiday home is situated with regard to the supply of gas, electric, fire, furnishings, disability and income-tax obligations for Non-UK Residents. Holi-lets.com cannot be held responsible for any regulations that owners/holiday customer(s) do not abide by.

 

 

Username & Password

holi-lets.com will provide all Owners & Bookers with a username and password so that they may make changes on-line, if desired, to their property description, availability, pricing, add special offers and to check their on-line account. Updating has been made easy and can be carried out from anywhere in the world!

 

BOOKINGS

Holi-lets.com will search all of the portals that the owner is currently advertising on to check availability on all platforms, before allowing the booker to make a holiday request through holi-lets.com, owners therefore only need to update holi-lets.com as holi-lets.com will automatically update all portals, there is a simple linking that enables this UNIQUE and TIME SAVING facility.

A computer generated confirmation of the booking will be emailed to the owner as soon as the deposit is paid on-line and the website availability section will automatically be updated. Holi-lets.com will automatically update any other portal that you may be advertising within too. A computer-generated receipt will be emailed to the bookers upon receipt of the on-line booking form, acceptance of the `Terms & Conditions’ and payment of the deposit (40% of the cost of the holiday accommodation) or the payment in full if the booking is made within eight weeks of departure. Owners and Holiday Bookers will be able to track their booking/s and payments made/due through their on-line account.

Only persons over the age of twenty one (21) years can make holiday bookings. The lead person will be responsible for the entire booking and its associated costs and upon signing/accepting the booking conditions, accepts the conditions on behalf of all of the party members.

 

`Enquiry only’ booking

Booking enquiries will be forwarded to the holi-lets.com admin team through the site, and when availability and pricing has been accepted by all parties, a member of the team will make the initial booking on line, and then as outlined in the afore-mentioned paragraph the holiday booker and owner will receive confirmation emails and the same procedures will apply to the booking. 

 

Availability

The Owner will be able to update the availability of the holiday property on-line with a username and password. Updates must be made as soon as a booking (period is taken for owners use) is taken by the owner direct through another portal, so that the website is as up-to-date as possible, avoiding double bookings.

holi-lets.com website will automatically update the availability for the property as soon as a booking has been made and update other linked portals too. An email will be automatically sent to the owner and booker confirming the booking.

OWNERS UNDERTAKE to make sure that they check availability at the holi-lets.com website before blocking off any periods for owners use/own bookings. There is no facility to hold bookings awaiting payment whilst bookers are vetted, liaising back and forth, this means replies must be prompt as bookers may be looking at several properties at a time.

Pricing

Owners will be able to change the pricing set on the holi-lets.com website on-line with a username and password, which will enable Owners to make reductions where necessary, and to forward-plan for the coming year’s charges. It is recommended that Owners refrain from continually changing their pricing schedules, in order to avoid confusion and mis-trust. 

 

Discounts

Owners are able to apply discounts to their properties on the holi-lets.com website.

 

Short Breaks

Owners are able to make their property available for days or weeks or a specific day of the week, whichever principle owners adopt this should be adopted within all of their advertising platforms.  

 

Property Advertisements

Property advertisements are accepted subject to the approval of holi-lets.com. The layout and design of the advertisement will be at the sole discretion of holi-lets.com.

If holi-lets.com considers that the advertisement or any part of it thereof would be detrimental to the reputation of the website or in any way inappropriate or offensive, hol-ilets.com reserves the right to suspend/alter the advertisement with immediate effect.

Holiday owners will not be able to link their website, however owners may import the holi-lets.com availability and pricing into their website to allow for on-line bookings 24/7, holi-lets.com. Please ask if you would like to take advantage of this facility.

 

Holiday owners will be able to upload VIRTUAL TOURS & VIDEO’S thus gaining more bookings through reducing the `disappointed on arrival’ visitor and potential disputes, gaining more regular future bookings.`BOOKING WITH CONFIDENCE’ is key to long term business sustainability and higher profits, supported through excellent reviews.

 

 

 

Payments to the Owners

Initial deposit payments will be held by holi-lets.com within their client account and will be forwarded to the owners along with the final payment and any agreed security deposit, less charges shortly after the commencement of the holiday.

It is the responsibility of the Owner to ensure that their banking details are kept up to date for the payments to be made via BACS transfer.

 

 

On-line Account

Owners will easily be able to access their on-line account held within the holi-lets.com website using their username and password. Owners will be able to see bookings made, and track their progress as well as the fees due to the owner.

 

 

BALANCE PAYMENTS by the Holiday Booker

It is the responsibility of the holiday booker to make sure that the balance payment of monies due is made eight weeks prior to departure to holi-lets.com via the website/over the phone or in person. If payments are not received by the due date holi-lets.com reserves the right to cancel the booking forfeiting the 40% deposit to the owner.

Security deposit

If a security deposit is required then this will be taken from the holiday booker with the final payment eight weeks prior to departure. The security deposit will be transferred to the owner with the final payment, and it is the owner’s responsibility to return it direct to the holiday customer shortly after vacation. No correspondence will be entered into by holi-lets.com regarding deductions from the security deposit.

Special requests 

Special requests by the holiday booker may be made in writing and are subject to approval by the owner.

 

CANCELLATION

Cancellation by the Holiday Booker

Cancellations made prior to eight weeks of holiday departure date, incur loss of deposit, cancellations made within eight weeks of holiday departure incur loss of total holiday cost. Any security deposit payments made on account will be returned in full. A surcharge will be payable upon cancellation by the holiday booker to holi-lets.com of 5%+VAT of the agreed rental for the agreed period, whether paid in full or not at time of cancellation, to cover administration. The holiday is non-transferable and the booker will have no further claim on the owner.  

Cancellation by the Holiday Owner

In the event that any booking made should be cancelled at any stage, holi-lets.com will not be held responsible, but will, endeavour to find alternative holiday accommodation. The Owner will be responsible for the full refund of any monies paid in deposit/in full, which will be refunded in full by the owner to the holiday booker via holi-lets.com. A surcharge will be payable upon cancellation by the holiday owner to holi-lets.com of 10%+VAT of the agreed rental for the agreed period, whether paid in full or not at time of cancellation, to cover administration. The holiday booker will have no further claim on the owner or holi-lets.com.

 

Acceptance

Acceptance of a booking by the Owner confers upon the holiday booker in the UK the right to occupy the property within the meaning of Section 9 of the Rent Act 1977 for a holiday.

 

Holiday property double-booked

In the event that any booking made should be inadvertently double booked, holi-lets.com will not be held responsible, but will however endeavour to find alternative holiday accommodation.

Holiday Booker Conduct & Damages

The holiday booker undertakes to take good care of the property and to keep the property and all furniture, fittings and effects in or on the property in the same state of repair and condition as at the commencement of the holiday (reasonable wear and tear accepted) and shall replace any breakages with similar articles of at least equal value, making sure that the property is left in a clean and tidy condition, to occupy the property in a quiet and courteous manner, to read and adhere to any written advice left in the property by the owners and to assist in the smooth running of the property.

If any item is damaged and cannot be easily replaced by the holiday booker should make contact with the owner/owner’s representative and an agreed payment should be made in lieu. If the damage is not reported before departure a claim will be made for damage or lack of cleanliness against the lead person after departure.

 

Holi-lets.com Liability

 

We do not accept liability for failure to meet any of our obligations, due to events that are deemed beyond our reasonable control.

 

If we breach our terms and conditions for reasons within our control, foreseeable or unforeseeable we shall not be liable whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way, for any indirect or consequential losses including:

  • loss of sales income or revenue; loss of business interruption; loss of business; loss of anticipated savings; loss of profits or contracts; loss of data; loss of reputation and/or goodwill / wasted management or office time.

 

Where we are liable to you (save as prohibited, governed and construed by applicable English law) our maximum liability to you whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the price of your booking reservation.

 

Holi-lets.com Commitment to Owners

holi-lets.com sells `Quality of Service’ and endeavours to make sure that the website is constantly featured optimising on search engine sites, in order to secure maximum bookings. Furthermore that the holi-lets.com site looks professional at all times.

 

 

Disputes

holi-lets.com shall not be responsible in the event of any dispute arising between the holiday booker and owner, and no correspondence will be entered into. Holiday bookers with grievances should make contact during their stay direct to the owner/owners’ representative.

 

Emergencies

In the unlikely event that the holiday booker cannot get hold of the owner/owner’s representative in the case of emergency, holiday bookers should act responsibly and only contact contractors where absolutely necessary. 

Equipment & Services

The holiday bookers are not entitled to compensation for failure of equipment or services. Should failure of any equipment or service occur during the occupier’s stay it should be reported immediately, upon which time the owner will endeavour to rectify the situation as quickly as possible. No correspondence will be entered into by the owner in connection with any complaint made after the property has been vacated by the holiday customer.

Occupants

Owners have safety/insurance restrictions regarding total numbers of permitted occupants, pets, smokers and children. Holiday bookers must therefore strictly adhere to these requirements.

No other person may reside at the property other than those listed on the booking form. Name changes are acceptable up until the date of the holiday commencement.

 

KEY ARRANGEMENTS

The holiday customer is required to make contact with the owner/owners representative a few days before departure to ascertain the key arrangements for the property. The owner undertakes to ensure that the keys are available on time. Owner/keyholder contact details will be emailed to the holiday customer within the final balance confirmation email.

 

VACATION

All holiday bookers must take a note of the time that they are required to vacate on the vacation day by the given time for that particular holiday property. Should the holiday booker fail to vacate on the designated date they may be liable to pay hotel bills for the incoming visitors and associated expenses.

Cleaning staff are pre-booked so unless the holiday customer has agreed with the owner prior to the stated vacation time that he/she wishes to prolong their stay and has paid for the extra-agreed period, all holiday bookers are expected to vacate on time.

 

LINKS TO THIRD-PARTY SITES

Or website may have links to third party sites, such hyperlinks are provided for your reference only. Holi-lets.com does not control such websites and is not responsible for their contents or the privacy or other practices of such websites. Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from this or any other website) is free of such items as viruses, worms, trojan horses, defects and other items of a destructive nature. holi-lets.com’s inclusion of hyperlinks to such websites does not imply any endorsement of the material on such third party websites or apps or any association with their operators.

In some cases, you may be asked by a third-party site or app to link your holi-lets.com account profile to a profile on another third-party site. You are responsible for deciding if you choose to do so, it is purely optional, and the decision to allow this information to be linked can be disabled (with the third-party site or app) at any time. If you do choose to link your holi-lets.com account to a third party site or app, the third party site or app will be able to access the information you have stored on your holi-lets.com account, including information regarding other users with whom you share information. HOLIDAY INSURANCE

Holiday Insurance for Bookers

We strongly advise that holiday bookers, whether travelling abroad or not, take out appropriate holiday insurance offering the same or greater protection to cover the likelihood of cancellation or curtailment. The cost of medical and other treatment overseas can be high, and if you do not have insurance holi-lets.com will not be held responsible for the refund of any holiday booked that is not available upon arrival, and as such will not be responsible for hotel bills and associated expenses that might be incurred. However holi-lets.com will do their very best to be of assistance and to mitigate the loss where possible.

 

Holiday Owners Holiday Property Insurance

holi-lets.com strongly advises that all property owners take out holiday lettings property insurance specifically for holiday homes as it is the responsibility of the property owner to be adequately insured for holiday rentals.  If for any reason the owner has to cancel the holiday accommodation, not only does he/she have to refund the customer any monies paid in full, pay a 10%+VAT surcharge to holi-lets.com.

Utilities

The Owner will maintain the property to the highest standard, paying for the gas, electricity, council tax, water, t.v. license, wifi, building/contents insurance, service/maintenance /management charges (unless otherwise stated within the property description).

N.B. If Owners require holiday bookers to pay for any utilities used during their stay, information regarding this requirement should be detailed within the description of the holiday property within the holi-lets.com website. Detailed information regarding payment for utilities must also be available at the holiday property.

 

Disclaimer

holi-lets.com does not promise that this site will always be available or that its operation will be error-free, nor do we accept responsibility for any adverse effects of accessing it, or downloading material from it. This includes adverse effects resulting from the downloading of viruses, the loss or corruption to material that is downloaded or any programs or data already on your system, and website-browser incompatibility problems.

Holi-lets.com is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the (holiday) price or fee to the relevant tax authorities and does not act as the merchant of record for any product or service made available on the Platform.

By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, accommodation owners) due to holi-lets.com publishing and using these photos/images. Holi-lets.com does not own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of all photos/images is assumed by the person who uploaded the photo, and is not the responsibility of holi-lets.com. The person who uploaded the photo warrants that the photos/images shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by holi-lets.com at any time and without prior notice.
